As reported by The Economic Times, Indian Railways fixed delivery period rules are set for future supply tenders. They are meant to keep critical procurement on schedule and strengthen contract compliance.

Why Indian Railways fixed delivery period rules are being introduced?

The move follows an investigation into a rail accident. It found that repeated extensions for safety-related items had affected availability.

Also, officials said the change should reduce routine administrative work. Junior and senior-scale officers now spend significant time on extension requests.

A senior official spoke on condition of anonymity. The official said, “The FDP mechanism will be applicable to fixed quantity supply contracts and not extended to rate contracts,” and added that it would be a special contract condition in store tenders usually floated at the Railway Board level.

The tighter clauses will apply to fixed quantity supply contracts. In those contracts, the number of items is agreed at the start.

Meanwhile, the official said the Railway Board expects precise planning. That applies to both production and delivery.

The official also said the national transporter regularly uses safety components and standard spare parts in areas with enough market competition to support strict delivery timelines.

In addition, a Railway Board directive was sent to production and maintenance units. It said the fixed delivery period mechanism should preferably be used where sufficient market competition is available.

“No deviation from the delivery periods and penalties involved shall be permitted in tenders floated with this safeguard mechanism,” the official said.

At the same time, railway units have been told to take a ‘cautious and realistic approach while fixing the delivery period’.

Separately, officials said contract drafters must consider several factors:

  • urgency of the item
  • quantity involved
  • availability of competition
  • complexity of manufacture
  • design consideration
  • past performance of suppliers

Still, the Railway Board said tenders will specify delivery periods in lots. That is meant to support severable contracts.

For example, quarterly delivery schedules may be preferred where feasible. Each severable contract will be treated separately, so termination and penalty enforcement can move faster.
