Swiss court upholds Stadler’s victory to supply trains for SBB

The Swiss Federal Administrative Court has dismissed Alstom’s appeal against SBB’s decision to enter into a Stadler framework agreement for the supply of 286 electric trains.
The tender, led by the Swiss Federal Railways (SBB), Thurbo and RegionAlps, includes three more contracts, which will result in the delivery of 510 electric trains for regional traffic, informs the railway magazine Railway Supply, citing Stadler.
The court decision confirms that SBB complied with the requirements of procurement law and equal treatment of bidders during the bidding process.
In October 2021, the three companies entered into a framework agreement with Stadler to manufacture and supply up to 510 Flirt single-deck electric trains.
As part of the initial order, it is planned to order 286 Flirt EMUs with an order volume of around 2 billion Swiss francs (1.93 billion euros). The framework agreement includes the possibility of acquiring up to 224 Flirt electric trains. Stadler says more information will be made public after the signing of the contract.
Litigation initiated by Alstom will affect the supply of trains. The first trains will now enter service before 2026, and not as previously planned. The new trains will gradually replace the existing train fleet until 2034. At SBB, the new trains will replace the first generation Domino and Flirt trains.
