The court decided to return the Norilsk railway from the ownership of Norilsk Nickel to the state.

The Arbitration Court of the Krasnoyarsk Territory, at the suit of the West Siberian Transport Prosecutor’s Office, decided to seize 11 objects of the Norilsk Railway from MMC Norilsk Nickel in favor of the state. Norilsk Nickel said it would appeal.

The court decision concerned the railway station in Norilsk, as well as railway sections, tracks, crossings and a bridge on Taimyr. In the summer of 2021, the prosecutor’s office filed a lawsuit with the court to return these objects to state property.

The decision of the arbitration states that the privatization of the Russian state concern for the production of non-ferrous and precious metals “Norilsk Nickel” took place on the basis of a decree of the President of Russia in 1993.

At the same time, the law prohibited the privatization of railways, facilities and property of railway transport involved in transportation.

In 2001, MMC Norilsk Nickel, on the basis of a sale and purchase agreement, registered ownership of the railway facilities. The seller of the assets was Norilsk Mining and Metallurgical Plant.

Rosimushchestvo stated in court that MMC registered ownership of the disputed facilities “without the consent and knowledge” of the federal agency.

A representative of Norilsk Nickel told the court that the railway at the time of privatization was an integral part of the unified complex of the concern and historically a technological railway. It did not carry passengers.

The Court held that these arguments were erroneous. Also, the MMC’s argument that the statute of limitations in the case has expired has not been taken into account. “The court found that the disputed objects were not included in the property of the enterprise being privatized, there are no grounds for calculating the limitation period from the date of property privatization, as the defendant claims,” the court order says.

As previously reported, in the Russian Federation, private freight cars are proposed to be transferred to the management of the state-owned Russian Railways.
