A public procurement system created in Ukraine guarantees equal conditions of tender participation both for Ukrainian and foreign companies.

However, state companies often write their requirements in such a way, for example, goods supply from absolutely different industries, that they make the tender participation impossible for the local companies. Thus in May 2021, a foreign company won more than a 50 million UAH tender declared by Ukrzaliznytsia regional branch, informs the Railway Supply referring to the manufacturer.

Among the numerous spare parts for diesel locomotives (they were the purchase purpose) were light bulbs, filters, bearings, various rubber sealers, etc. Still instead of holding a few tenders, providing a market price for itself and competitive struggle for the Ukrainian manufacturers Ukrzaliznytsia combined everything in one tender narrowing the bidders’ number to one. The state companies such as Ukrzaliznytsia vividly demonstrate their position despite the fact that there are manufactures producing European quality goods for Ukrainian price in Ukraine.

For example, Kievguma LLC is an enterprise with its own certified laboratory, confirmed European quality production management certificates. It supplies railway goods to the EU countries with its own and other brands. It would be able to provide Ukrzaliznytsia with almost all rubber and technical products. However, the “great” tenders participation conditions including diversified products supply, exclude the Ukrainian manufacturers from the competition.

Let us remind you that cooperation with a foreign company is not only related to receiving of “better” goods and services. It also includes dependence of the state from demands and interests of foreign business, loss of potential working places for the Ukrainians and a long list of other consequences. Only for the first two years starting from Prozzoro implementation non-resident participants concluded the agreements for 9.7 milliard hryvnias. This is a little plus of Prozzoro as an open and transparent purchase tool. Still that is a huge minus for the state policy of “stagnation” and budget of each Ukrainian.
