Canadian Pacific Railway is suing Maple Leaf Foods and one of its truck drivers, alleging he caused a train derailment by driving through a highway crossing outside Winnipeg two years ago. CPR is seeking a judgment of more than $300,000, interest and court costs.

Attorneys Ari Hanson and Alexa Smith have lodged a claim in Manitoba Court on behalf of Canadian Pacific Railway. The company says the damages, which include locomotive repairs and delays in train services, were the result of the driver’s negligence.

The semi came up to a railway crossing on Highway 23 at about 100 km/h. The warning signals were working and were fully active when the semi driver did not stop and collided with a train.

Canadian Pacific Railway References Negligence in Legal Proceedings Against Maple Leaf Foods

The railway claims both the driver and Maple Leaf Foods owe a duty of care to ensure these types of incidents do not happen. As a result of their lack of oversight of safe driving, they incurred serious financial losses and disturbances on the railway, the lawsuit says.

The driver was given a traffic ticket under the Highway Traffic Act after the crash. The locomotive and the track sustained damage from the derailment, which had to be repaired and subjected to environmental cleanup, which cost roughly $307,363.

The three other trains were also delayed following the accident, resulting in the further loss, the railway mentioned. The defendants have been sued after repeated requests for payment but have failed to pay for their damage, prompting the litigation.

And Canadian Pacific, currently known as Canadian Pacific Kansas City, following a 2023 merger, remains on the hunt for financial recovery. The firm maintains that the culprits must be held liable for the financial fallout of the breach.
