The enterprise of the aggressor country, which produces military equipment and rolling stock, Uralvagonzavod from Nizhny Tagil, must pay 10.6 million rubles for 222 defective wagons.

Uralvagonzavod produced defective wagons

It is reported by the railway magazine Railway Supply with reference to tagilcity.ru. 

In 2011, Promtransinvest JSC from Moscow purchased wagons from the Tagil enterprise. However, during the warranty period, 222 of them were found to have deficiencies, including defective draft gears.

The buyer, at his own expense, eliminated defects in the amount of 13.4 million rubles. and turned to Uralvagonzavod with a claim for reimbursement of expenses, but to no avail. At the same time, Promtransinvest JSC reduced the amount of expenses to 10.6 million rubles. due to the fact that they took the defective parts into the property at the price of scrap.

In response, Uralvagonzavod filed a counterclaim for damages in the amount of 3 million rubles. The company’s arguments that in relation to 93 draft gears the car repair depots bear warranty obligations were rejected by the court, since the contract does not limit the period of the 8-year warranty for parts to the fact of carrying out a scheduled repair of the car.

As a result, the Moscow Arbitration Court decided to fully satisfy the claim of Promtransinvest JSC, and left the counterclaim unsatisfied. The Tagil enterprise filed an appeal, but the decision of the court of first instance was upheld. On April 11, Uralvagonzavod filed an application with the cassation instance to suspend the enforcement of the judgment.

As previously reported, due to a lack of foreign-made components, the work of enterprises of the Russian corporation Uralvagonzavod was suspended.
