“Belaruskali” lost the lawsuit to cancel the transit of fertilizers by Lithuania
13.04.2022
The Vilnius Regional Administrative Court dismissed Belaruskali’s complaint against the decision of the Lithuanian government and the Commission for Coordinating the Protection of National Security Sites, which led to the denial of Belaruskali’s fertilizer transit, reports Railway Supply magazine with reference to lrt.lt.
In January Belaruskali, included in the US and EU sanctions lists, appealed in court the decision of the Lithuanian government, according to which LTG had to terminate the long-term contract with Belaruskali on the transit of its fertilizers through Lithuania from February 1.
According to the court, the agreement between one of the largest Belarusian fertilizer producers and Lithuanian Railways on the transportation of millions of tons of fertilizers through Lithuania posed a threat to the national security of the country.
“In fact, the applicant did not deny his established connections with the undemocratic regime in Belarus. These conclusions were substantiated and presented by the interested institutions with information, as well as other written data of the case. This ground alone, in terms of legal regulation, is sufficient to recognize an agreement that does not meet the interests of national security,” the court said in a statement.
It should be reminded that since February 1, Lithuania canceled the contract on the transportation of fertilizers due to sanctions against Belaruskali OJSC. In response, Belarus has banned the transit of oil products and fertilizers from Lithuania since February 7. According to several companies, transportation of fuel from Lithuania to Ukraine will be carried out through Poland. There are also terminals on the border with the EU ready to accept other Lithuanian goods.
In mid-February, Ukrzaliznytsia also introduced restrictions on the transportation of Belarusian fertilizers.
