The Arbitration Court Dismissed Pesa’s Multimillion-Euro Lawsuit Against Uraltransmash: What’s Next?

The Arbitration Court of the Sverdlovsk Region has dismissed the lawsuit filed by the Polish company Pesa, which sought to recover €55.2 million from Uraltransmash, this is reported by the railway transport news portal Railway Supply.

The main reason for the lawsuit was a decision made by the Arbitration Institute of the Stockholm Chamber of Commerce in May 2021, which, according to the Polish manufacturer, should have been enforced.

As part of this decision, Pesa demanded payment of debts under a contract from the early 2010s for the supply of 120 three-section trams of the 71-414 model for Moscow.
According to Pesa, Uraltransmash owes €18.4 million for unpaid trams.
In addition, the Polish side sought compensation for interest and penalties that were allegedly accrued over the past years.
However, despite the arguments presented, the court in Yekaterinburg did not satisfy the claim.
It is important to note that the court’s reasoning has not yet been published.
Therefore, the details behind the court’s decision remain unknown.
Nevertheless, Pesa retains the right to appeal the ruling in the Arbitration Court of the Ural District. The company has one month to do so.
Thus, the situation surrounding the recovery of a large sum from the Russian enterprise remains unresolved and may continue in higher courts.
